Consultant Websites Agreement

Summary

We will always do our best to fulfill your needs and meet your expectations, but it’s important to have things written down so that we both know what’s what, who should do what and when, and what will happen if something goes wrong. In this agreement you won’t find any complicated legal terms or long passages of unreadable text. We have no desire to trick you into agreeing with something that you might later regret. What we do want, is what is best for both parties, now and in the future. So in short; You (Land Asia Property Consultant), agree to accept the terms and conditions of our (Land Asia Realty and Development Corporation/Creators Nook) located at Unit 4 Ground Floor Geson Building, D. Jakosalem Street, Cebu City, Cebu, 6000, Philippines, design and support services at a fixed total price of either P100.00 for our SILVER support package or P200.00 for our GOLD support package. Of course it’s a little more complicated, but we will get to that.

What both parties agree to do

You: You have the authority to enter into this agreement on behalf of yourself, your company or your organization. You will provide us with everything we need to complete the project as and when and in the format needed. You will review our work, provide feedback and approval in a timely manner too. Deadlines work two ways, so you will also be bound by any set dates. You also agree to stick to the payment schedule set out at the end of this agreement. Creators Nook: We have the experience and ability to do everything we have agreed with you and we will do it all in a professional and timely manner. We will endeavor to meet every deadline that is set and on top of that we will always maintain the confidentiality of everything you give us.

We are not responsible for writing or inputting any text copy. If you’d like us to write new content or input text for you, we can still do so within certain limitations based on our agreement.

Photographs

You should supply graphic files in an editable, vector digital format. You should supply photographs in a high resolution digital format. If you choose to buy stock photographs, we can suggest stock libraries. We can also provide you with logo design for your Property Consultant website.

HTML, CSS and Javascript

We deliver templates developed from HTML5 markup, CSS3 stylesheets for styling and unobtrusive Javascript for feature detection, poly-fills and behaviors.

Technical support

We offer full support for our website hosting, email or other services relating to hosting. We can set up your site with any statistics software such as Google Analytics.

Legal stuff

We can’t guarantee that our work will be error-free and so we cannot be liable to you or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if you have advised us of them. Finally, if any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. Phew.

Copyrights

First, you guarantee that all elements of text, images or other artwork you provide are either owned by your good selves, or that you’ve permission to use them. Then, when your final payment has cleared, copyright will be automatically assigned as follows: You’ll own the visual elements that are create for your Property Consultant website, not including any content that will be automatically posted to your site from the network. You own all elements of text, images and data you provided, unless someone else owns them. We will own the unique combination of these elements that constitutes a complete design and we will license that to you, exclusively and in perpetuity for your Land Asia Consultant website, unless we agree otherwise. We love to show off my work and share what I’ve learned with other people, so we reserve the right, with your permission, to display and link to your website as part of our portfolio and to write about it on websites, in magazine articles and in books.

Changes and revisions

We know from experience that fixed-price agreements are rarely beneficial to you, as they often limit you to your earliest ideas. We don’t want to limit your ability to change your mind. The price at the beginning of this agreement is based on a set rate established to be the most beneficial to all parties concerned. However, if you want services which are above and beyond the scope of this agreement, so long as to maintain your status as a Land Asia Property Consultant, we will happily make the necessary arrangements to make these services available to you.

Payments

I’m sure you understand how important it is as a small business that you pay the monthly support fees in a timely fashion and if possible, make arrangements to pay the full annual amount in a lump sum in order to avail a 20% discount. As we also sure you will want to stay friends, you agree to stick tight to the attached payment schedule.

But where’s all the horrible small print?

Just like a parking ticket, you cannot transfer this agreement to anyone else without our permission as this service is only available to ACTIVE Land Asia Property Consultants. This agreement stays in place and need not be renewed. If for some reason one part of this agreement becomes invalid or unenforceable, the remaining parts of it remain in place. Although the language is simple, the intentions are serious and this agreement is a legal document under exclusive jurisdiction of Cebu City courts.
